This Cookies Policy is drawn up by Birim Makina San. ve Tic. A.Ş. (“Birim Makina”), in its capacity as the data controller, to provide information to you regarding collection, processing and transfer of your personal data during your visit to the web site, www.birimrecycling.com.tr (“Site”), operated by our company, the intended purposes of processing operations, the legal grounds as well as your rights under the Law on Protection of the Personal Data No. 6698 (hereinafter shall be referred to as the “KVK Law”. In this Clarification Text on Cookies, we would like to disclose to you what type of cookies we use and the intended purposes thereof, as well as how you can control such cookies.

Processed Personal Data

As Birim Makina, we take advantage of certain technologies such as cookies, pixels, gifs (the “cookies”) to improve your experience during your visits to our online channels. Such technologies are used in accordance with the legislation applicable to our company, in particular the KVK Law.

As Birim Makina, we can abandon use of the cookies that we use on the Site, change the types or the functions thereof, or add new cookies to the Site. Therefore, we hereby reserve the right to amend the provisions of this Clarification Text on Cookies any time. Any changes made on current Clarification Text on Cookies shall take effect following publication thereof on the Site or any media open to public.

The Method Applicable, and Legal Grounds, for Collecting the Personal Data 

Your personal data is collected during your visit to the Site or due to your use of our application through cookies in the electronic media on the basis of the legal grounds intended for the legitimate interests of Birim Makina. Your personal data so collected can also be processed for the purposes as set out in this Clarification Text on Cookies pursuant to the conditions and purposes of processing the personal data as set forth in Article 5 of the KVK Law.

The Persons Eligible for Transferring the Personal Data and the Intended Purpose of such Transfer 

As Birim Makina, we may share your personal data within the context of the Disclosure Text on Cookies with our suppliers, group companies, legally empowered public institutions and natural persons, however being restricted only to achievement of the purposes set forth above, and in line with the applicable legislation. We would also like to point out that the parties to whom the data is transferred may store your personal data on their servers all over the world.

In General

As Birim Makina, we use cookies on the Site for various purposes, and we process your personal data through such cookies. Said purposes are mainly as follows:

To perform the core functions required for functioning of the Site. For instance, the members logged-in to the site do not need to reenter passwords when visiting different pages on the Site.

Analyzing the Site and improving the performance of the Site. For instance, integration of different servers on which the Site runs; determining the number of visitors of the Site and adjusting performance accordingly; or facilitating search for the visitors to find their intended search topics.

Improving the functionality of the Site and ensure ease of use. For instance, posting to the third-party social media channels through the site, recalling the username information or search queries for the next visit of the visitor to the site.

What are Your Rights as the Data Subject?

In accordance with article 11 of the KVK Law, the data subjects are entitled to:

1. a) Learn whether the personal data is processed,
2. b) If the personal data has been processed, requesting information regarding such processing,
3. c) Learning the purpose of processing the personal data and whether such data is used properly for the intended purpose,

ç) Learning the third parties to whom the personal data has been transferred domestically or abroad,

1. d) Requesting correction of the personal data if the data is incomplete or processed incorrectly,
2. e) Requesting deletion or destruction of the personal data pursuant to the conditions stipulated in article 7,
3. f) Requesting notification of the actions taken in accordance with items (d) and (e) to the third parties to whom the personal data is transferred,
4. g) Raising objection to emergence of any outcome against the person by analyzing the processed data exclusively through automated systems,

ğ) Requesting compensation in case of suffering any damages due to unlawful processing of the personal data.

Application Procedure

Relevant requests should be forwarded in writing to address of Birim Makina at Halilbeyli OSB. Mahallesi İzmir Caddesi No:11/2 Kemalpaşa/İZMİR via notary public. Any request to be forwarded to the e-mail address should be sent to birimmakina@hs02.kep.tr info@birimmakina.com.tr by using the registered electronic mail (KEP) address, secure electronic signature, mobile signature or the requesting party’s electronic mail address registered with Birim Makina, or by means of the software or application developed for the application directed to the birimrecycling.com.tr site, if any. 

The applications so submitted should be drafted in Turkish language using the application form provided at this link, and the request must be written explicitly to allow comprehension thereof without any hesitation, and the credentials as well as the documents and information related to the subject matter should be enclosed to the application. The requests submitted on behalf of others must include the information on the credentials and address of the requesting party and the legal instruments documenting authorization to represent the requesting party. 

Any applications to be filed in this respect shall be concluded in the shortest time frame possible but, in any case, within 30 (thirty) days at maximum. In the event of incomplete information and documents, said period shall commence as of the date on which such deficient information and documents are fully communicated. The applications are currently free of charge. However, if the transaction requires any additional cost, the fee provided in the tariff set out by the Personal Data. 

The responses can be either sent to the requesting party’s address by e-mail, or can be forwarded to the or e-mail address depending on Birim Makina's preference. 

The data subject hereby acknowledges that he/she may not be able to take full advantage of the functions available at the Site in the event where he/she files any request that would result in unavailability of his/her personal data to Birim Makina, and declares that any responsibility arising in this context shall rest on him/her.
